Jurisdiction: Felony & Misdemeanor Offenses
The State of Maryland has the authority or jurisdiction over criminal and serious traffic offenses when one the following occurs:
- An act constituting an element of the offense was committed in the State
- An act outside the State caused an offense to result within the State
- The act involved the neglect of a duty imposed by law of the State.
The two classes of crimes are felonies and misdemeanors, which are investigated by the police and prosecuted by the State's Attorney Office.
Most cases including serious traffic offenses, misdemeanors, and certain felonies are brought before the District Court while more serious felony cases, such as murder, armed robbery, rape, and distribution of narcotics, to name a few, are brought before the Circuit Court.
